Employment Law Update: VETS 100 and VETS 100A Reports Are Due September 30, 2010

As a reminder to all federal contractors and subcontractors, Thursday, September 30, 2010 is the deadline for VETS 100 and VETS 100A reports to be filed.  VETS 100 and VETS 100A reports request information regarding the employment of disabled veterans, other protected veterans, armed forces service medal veterans and recently separated veterans for the proceeding 12 month period.  The information collected is used by the Department of Labor and the Veterans’ Employment and Training Service (“VETS”).

All federal contractors and subcontractors must file a VETS 100 form in 2010 if they have at least one active contract or subcontract that was entered into before December 1, 2003 and has a value of $25,000 or more. 

It is important to note that if the contract or subcontract was modified on or after December 1, 2003 and the modified amount totals $100,000 or more, a VETS 100A form, not a VETS 100 form, should be filed.

All federal contractors and subcontractors must file a VETS 100A form in 2010 if they have at least one active contract or subcontract that:

(1)   was entered into on or after December 1, 2003 and has a value of $100,000 or more; and/or

(2)   was modified on or after December 1, 2003 and has a value of $100,000 or more as modified.

Both forms must be completed if the contractor or subcontractor has: (1) an active contract or subcontract in the amount of $25,000 or more that was entered into before December 1, 2003 and not modified on or after that date; and (2) an active contract or subcontract in the amount of $100,000 or more that was entered into or modified on or after December 1, 2003.
