The Defense Production Act (DPA) provides the federal government a means to prioritize and/or allocate critical materials, equipment and services in the private market in the interest of national defense. The power is generally exercised through the issuance of rated orders to government contractors, which come with significant additional compliance hurdles. In the wake President Trump’s Executive Order concerning the DPA and COVID-19, this webinar will provide a guide to government contractors, subcontractors and suppliers on what to do if they receive a DPA rated order. We will also discuss the potential impact state/local shelter-in-place directives may have on a government contractor’s ability to comply with rated and unrated orders.
